Columbia, SC, January 16, 2009 -- A South Carolina school official who alleges she was wrongfully placed on administrative leave twice in less than one year has filed a lawsuit against the school district where she works.

Assistant Superintendent Fayette Nick filed a lawsuit on Jan. 8 against Hampton School District Two, alleging breach of contract, libel and slander. The Hampton County case is Fayette Nick v. Hampton County School District 2 (Civil Action #: 2009-CP-25-004).

Nick is being represented by Herbert Louthian, an employment law attorney with the Louthian Law Firm in Columbia, S.C. Other lawyers on the case are Korey L. Williams and Virgin Johnson, Jr.

According to Nick's complaint, the first leave was ordered by a former superintendent in May 2008, based on allegations of discrepancies in her original job application. Nick was reinstated in July 2008, the suit contends, after a school board review found the leave was wrongfully imposed.

In December 2008, an interim superintendant placed Nick on leave for a second time based on the previous allegation for which she had already been cleared.

Nick also contends that in November 2008 she signed a contract to become interim superintendent. However, after the November 2008 election the new Hampton Two Board would not honor her contract, she alleges.

The plaintiff's lawyers have requested a jury trial.
